These Terms and Conditions (“Terms”) are a contract between you and Syed Khizer, an individual, trading as Functional Apps (“Primal,” “Functional Apps,” “we,” “us,” or “our”). They govern your use of the Primal iOS application and related services (together, the “Service”).
By creating an account, purchasing access, or using the Service, you agree to these Terms, acknowledge the Privacy Policy, and represent that you are 18 or older. Links to these Terms and the Privacy Policy appear on the welcome, paywall, and account screens, and all three policies are available from Settings → Legal. If you do not agree, do not use the Service.
1. Who we are
Operator: Syed Khizer, an individual, trading as Functional Apps
Support and legal email: admin@functionalapps.org
2. Eligibility and adult-only service
You must be at least 18 years old and legally able to enter into a contract to use Primal. By using the Service, you represent that you meet these requirements. You may not use Primal on behalf of a person under 18.
Primal does not verify identity, use age-assurance technology, or ask an in-app age question. Your use of the Service, including creating an account, is your confirmation that you are 18 or older. The absence of a verification step does not change the 18+ eligibility requirement or your representation that you satisfy it.
If we reasonably believe that an account belongs to someone under 18, we may suspend it and delete associated information, subject to applicable law.
3. What Primal provides
Primal is a self-help and habit-change service. Depending on the version and your settings, it may offer onboarding assessments, goals, streaks, pledges, check-ins, urge and relapse logs, focus exercises, achievements, Screen Time blocking tools and a limited DNS filter, an AI coach called Leo, notifications, and community features.
Features may differ by country, device, operating-system version, permissions, subscription, and product version.
4. Not medical or emergency care
Primal is not a healthcare provider, medical device, diagnosis, treatment, therapy, counselling, or crisis service. Assessments and scores are based on your answers and are for self-reflection only. They are not clinical diagnoses.
Leo is generated by artificial intelligence. It can misunderstand you, omit context, or provide inaccurate or inappropriate output. It does not know your full medical history and must not replace advice from a qualified professional. You are responsible for evaluating any output before relying on it.
Primal does not monitor the Service for emergencies and cannot dispatch help. If you may harm yourself or another person, or are otherwise in danger, stop using the Service and contact local emergency services or an appropriate crisis service.
5. Your account
The current version requires Sign in with Apple. You must provide accurate information and keep your device and Apple account secure. You are responsible for activity under your account unless caused by our failure to use reasonable security.
Do not share, sell, transfer, or allow another person to use your account. Contact admin@functionalapps.org promptly if you believe your account has been compromised.
Primal may generate a public handle for community use. A handle does not guarantee anonymity: information you post can reveal who you are. Do not publish information you want to keep private.
6. Purchases, subscriptions, trials, and lifetime access
This section forms Primal's subscription terms. By purchasing or renewing paid access, you agree to this section, the rest of these Terms, the Privacy Policy, and the product and billing information Apple displays immediately before confirmation. If you do not agree, do not complete the purchase. Paying for Primal does not turn the Service into medical care, create a professional relationship, or guarantee any recovery, abstinence, behavioural, emotional, or health outcome.
6.1 Products and prices
Primal may offer auto-renewing weekly, monthly, or annual subscriptions and may offer a one-time lifetime-access purchase. Not every product is offered to every user or in every version.
The current iOS version accepts payment only through Apple's in-app purchase system. Primal does not currently offer Google Play or direct Stripe subscription checkout.
The product, billing period, local price, currency, taxes, introductory offer, and other purchase terms shown on the App Store purchase sheet immediately before you confirm are the terms that apply to that purchase. App Store prices and availability may change. We do not hard-code a guaranteed price in these Terms.
6.2 Billing and auto-renewal
Apple processes payment using your Apple Account. An auto-renewing subscription continues for successive periods unless you cancel it through Apple before the renewal deadline shown by Apple. Apple charges your payment method and handles billing, regional taxes, family-sharing eligibility, and payment failures under its terms. By confirming the purchase, you authorise Apple to charge the displayed price for the initial period and each renewal until cancellation. Primal does not independently charge your card or Apple Account.
You can view, manage, or cancel a subscription in your Apple Account subscription settings. Removing the app or deleting your Primal account does not cancel a subscription.
6.3 Trials and introductory offers
A trial or introductory offer applies only when it is displayed to you on the App Store purchase sheet. Eligibility, duration, price after the offer, and renewal terms are shown before confirmation and are controlled by Apple. Unless you cancel within Apple's displayed deadline, a trial or introductory subscription converts to the paid auto-renewing subscription shown at purchase.
6.4 Lifetime access
If offered, “lifetime” means access to the then-supported premium features of Primal for as long as we operate the Service; it does not refer to your biological lifetime and does not guarantee that every current feature or third-party service will remain available forever. Any non-waivable consumer rights still apply.
6.5 Refunds and price changes
Apple controls App Store refunds. You may request a refund through Apple's published refund process. We will provide any refund or remedy that applicable law requires.
Apple may notify you about subscription price changes and request consent where required. Your statutory consumer rights are not limited by this section.
6.6 Cancellation, expiration, and access
You can manage or cancel an auto-renewing subscription through the subscription controls in Primal or your Apple Account settings. Cancellation turns off future renewal; it does not ordinarily end the period you already paid for. Unless Apple applies a refund, revocation, billing failure, or another entitlement change, paid access normally continues until the end of that billing period.
When a subscription expires, Primal may return the account to the free service and paid-only features become unavailable. Your account and recovery information are not deleted merely because paid access ends. You may continue to use available free features or separately request deletion under Section 15 and the Privacy Policy.
Deleting the app or your Primal account does not cancel an Apple subscription, and cancellation does not delete your Primal account. To avoid another renewal, manage the subscription through Apple separately. We provide an in-app route to Apple's subscription-management interface, but Apple controls the final billing and cancellation status.
Restoring paid access may require the Apple Account used for the purchase and a compatible Primal account. Access across devices remains subject to Apple's purchase rules, the current entitlement state, and any Family Sharing availability shown by Apple.
6.7 Paid features and service changes
The features included in paid access are the features described in Primal and on the App Store purchase screen at the time of purchase. We may improve, replace, add, or remove features as the Service develops, subject to applicable law and our obligation to provide the subscription service as marketed during the applicable paid period. If a material change affects paid access, we will provide notice and any cancellation, refund, or other remedy required by law or Apple's rules.
Premium tools, insights, content, blocking features, and Leo remain subject to the limitations in Sections 4, 7, 8, 14, 16, and 17. Individual results vary, blockers can fail or be bypassed, and AI output can be inaccurate. Do not rely on paid features as medical treatment, therapy, emergency support, or a guarantee of any particular result.
7. AI coach
Leo is off until you enable Leo AI in Settings → Privacy & data; you must enable it before the first message can be sent. When you use Leo, you authorise Primal to send your message, limited recent conversation context, and a short recovery context to our AI service providers as described in the Privacy Policy. Do not submit another person's confidential information without authority.
AI output is generated automatically and is not guaranteed to be original, complete, safe, or accurate. Similar output may be generated for other people. You may use Leo output for your personal, lawful use, subject to these Terms and any rights belonging to others. We do not claim ownership of the prompts you submit.
You must not use Leo to obtain or distribute unlawful content, exploit minors, facilitate self-harm or violence, evade safety controls, or interfere with the underlying providers.
8. Blocking features
Screen Time blocking is an optional tool intended to add friction. When protection is enabled, Primal applies Apple's adult website filter by default, along with any custom websites and apps you select. It does not guarantee that content will be identified, blocked, unavailable, or impossible to bypass. Operating-system changes, permissions, other devices, and unsupported apps or browsers can affect it.
The DNS filter feature currently runs in a limited mode that does not route your queries to any external DNS vendor. If an external provider is enabled we will name it in the Privacy Policy first. Network conditions, VPNs, encrypted traffic, and provider availability can affect any DNS-based filter.
You are responsible for deciding whether to enable a blocker and for checking that it works for your circumstances. Do not rely on Primal where blocker failure could cause personal injury, legal exposure, or another serious loss.
9. Community standards
Community features are intended for supportive, lawful recovery discussion. You may not post, upload, or facilitate:
- pornographic, sexually explicit, exploitative, or triggering media or links;
- content involving the sexual exploitation or abuse of a minor;
- harassment, threats, bullying, stalking, hate, or targeted abuse;
- encouragement or instructions for self-harm, suicide, violence, or relapse;
- another person's private or identifying information without permission;
- scams, spam, unauthorised advertising, malware, or impersonation;
- content that infringes privacy, copyright, trademark, or other rights;
- attempts to manipulate streaks, votes, reactions, entitlements, or service systems; or
- any illegal activity or attempt to evade moderation or security controls.
We may use automated systems and human review to filter, review, restrict, or remove content and may warn, suspend, or terminate accounts. We are not required to monitor every item and cannot guarantee that all objectionable content will be detected. Report concerning content using the in-app tools or admin@functionalapps.org.
Other users' content is their responsibility. We do not endorse or verify it, and it is not professional advice.
9.1 Child safety and exploitation
Primal has zero tolerance for child sexual abuse material, child sexual exploitation, grooming, trafficking, or any content or conduct that sexualises, exploits, endangers, or harms a minor. You must not create, possess through the Service, upload, request, share, link to, encourage, or facilitate such material or conduct.
We may immediately remove relevant content, preserve evidence where lawful, suspend or permanently terminate accounts, and report suspected exploitation to competent authorities or child-safety organisations when required or permitted by law. Report child-safety concerns through the in-app reporting tools or to admin@functionalapps.org. Primal does not promise continuous or real-time monitoring.
10. Your content and licence to us
You retain the rights you have in content you submit. You represent that you have the rights and permissions needed to submit it and that it complies with these Terms.
When you publish content through a community feature, you give us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, adapt for technical display, moderate, distribute, and display that content only as reasonably needed to operate, secure, improve, and promote the in-app community. The licence ends when the content is deleted from our active systems, except for limited copies kept for backups, legal obligations, safety, dispute resolution, or enforcement. When your account is deleted, your posts, replies, photos, votes, and reactions are deleted; abuse reports and moderation-queue records that reference you are not deleted but are anonymised (user identifiers replaced with “deleted”, content fields removed, only reason, status, outcome, and timestamps kept) and retained for up to 24 months for safety, enforcement, and dispute resolution, as described in the Privacy Policy.
Private journal entries stored only on your device are not licensed to us. Feedback, ideas, or suggestions you voluntarily send may be used without restriction or payment, but we will not publicly identify you without permission.
11. Acceptable use of the Service
In addition to the community rules, you may not:
- break the law or violate another person's rights;
- access another person's account or non-public data;
- reverse engineer the Service except where law expressly allows it;
- scrape, probe, overload, disrupt, or bypass access, security, rate, purchase, or moderation controls;
- introduce malicious code or use automation that harms the Service or its users;
- resell or commercially exploit the Service without written permission; or
- use the Service to build or train a competing product or AI model.
12. Our intellectual property
Primal, including its software, design, text, graphics, branding, and service content (excluding your content and third-party materials), belongs to us or our licensors and is protected by intellectual-property laws.
Subject to these Terms and your applicable purchase, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Primal on Apple-branded products you own or control as permitted by the App Store Usage Rules. Primal may also be accessed and used by other accounts associated with the purchaser through Family Sharing or another mechanism that Apple permits. No other rights are granted.
13. Third-party services
Primal depends on services supplied by Apple, Google Firebase (including Crashlytics), RevenueCat, PostHog when product analytics is enabled, OpenRouter, and eligible third-party inference hosts when Leo AI is enabled. Where optional Meta ad measurement is available in your version of the app and you allow it, Primal and RevenueCat also share the limited information described in the Privacy Policy with Meta Platforms so that we can measure our advertising; declining or turning it off does not affect your access, your subscription, or any feature. The DNS filter does not currently use an external DNS vendor. Leo uses OpenAI GPT-OSS-120B, an open-weight model developed by OpenAI and licensed under Apache 2.0; OpenAI's role as model developer does not mean OpenAI operates the current OpenRouter-selected inference host or receives your prompts. Their services may be unavailable or change, and their own terms and privacy notices may apply.
Links or references to third-party resources do not mean that we endorse or control them. We are not responsible for independent third-party services except to the extent applicable law says otherwise.
You must comply with applicable third-party terms when using Primal, including the Apple Media Services Terms and any terms governing your wireless-data or internet service.
14. Changes and availability
We may add, modify, suspend, or discontinue features to improve the Service, address security or legal requirements, or respond to third-party changes. We do not promise that the Service will always be available, uninterrupted, error-free, or compatible with every device.
If we discontinue a paid Service, we will provide notice and any remedy required by applicable law. Streaks, achievements, arena states, and similar in-app measures have no cash value and may be corrected or reset when needed to fix errors or abuse.
15. Suspension, termination, and account deletion
You may stop using Primal at any time and delete your account in Settings → ACCOUNT → Delete my account, which opens the Privacy & data screen; tap Delete my account there and choose Delete now or Delete after 24 hours. The 24-hour option can be cancelled before the deadline. You can also export your data first from Settings → Privacy & data → Export my data. What deletion removes, and the anonymised moderation records it keeps, is described in the Privacy Policy.
We may restrict, suspend, or terminate access if you materially or repeatedly breach these Terms, threaten users or the Service, expose us to legal risk, or if required by law. Where reasonable and permitted, we will give notice and an opportunity to appeal by emailing admin@functionalapps.org.
Account termination does not automatically cancel an Apple subscription. Provisions that by their nature should survive—including intellectual property, content licences for retained copies, disclaimers, liability limits, disputes, and payment obligations— continue after termination.
16. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, non-infringement, and any warranty arising from course of dealing. We do not guarantee a particular recovery result, continued abstinence, the accuracy of an assessment or AI response, or the effectiveness of a blocking tool.
Nothing in these Terms excludes warranties or consumer guarantees that cannot lawfully be excluded.
17. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or loss of profits, revenue, goodwill, or data, arising from the Service.
To the fullest extent permitted by law, our aggregate liability arising out of the Service will not exceed the greater of (a) the amount you paid for Primal in the 12 months before the event giving rise to the claim or (b) USD 50.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable. Some jurisdictions do not allow certain exclusions or limits; in that case, they apply only to the maximum extent allowed. Your mandatory consumer rights remain unchanged.
18. Indemnity
To the extent permitted by law, if you use Primal for business purposes or in breach of these Terms, you will indemnify us against third-party claims and reasonable costs caused by your unlawful content, your infringement of another person's rights, or your material breach. This section does not require a consumer to indemnify us for our own conduct and does not limit non-waivable consumer rights.
19. Governing law and disputes
These Terms are governed by the laws that apply to Syed Khizer as the operator and to you as a user, without limiting any mandatory consumer protections. A dispute may be brought in any court that has jurisdiction under applicable law.
Nothing here prevents either party from seeking urgent injunctive relief or using a small-claims process where available. If you are a consumer, you retain the mandatory protections of the country in which you habitually reside.
20. Changes to these Terms
We may update these Terms. If a change materially affects your rights, we will provide reasonable notice through the Service or another appropriate channel before it takes effect, unless an urgent legal or security change requires faster action. If consent is required, we will ask for it. The “Last updated” date identifies the current version.
21. General terms
If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganisation, financing, or sale, subject to applicable law. These Terms and the documents they incorporate are the entire agreement about the Service and replace prior agreements on that subject.
22. Apple-required terms
These Terms are between you and us, not Apple. We, not Apple, are solely responsible for Primal and its content, maintenance, and support. Apple has no obligation to provide maintenance or support.
If Primal fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by the App Store terms. To the maximum extent permitted by law, Apple has no other warranty obligation for Primal. We, not Apple, are responsible for addressing claims relating to Primal, including product-liability, legal-compliance, and consumer-protection claims, and for investigating intellectual-property claims.
You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism and that you are not on a United States government prohibited- or restricted-party list.
Apple and its subsidiaries are third-party beneficiaries of these Terms. After you accept them, Apple may enforce them against you as a third-party beneficiary.
